These Terms and Conditions ("Terms") govern your use of this website and apply to all purchases made through Ecotune UK Ltd. By placing an order, you confirm that you have read, understood, and agree to be bound by these Terms.

1A. Consumer and Business Customers
1A.1 These Terms apply to both consumers and business customers.
1A.2 A “consumer” means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
1A.3 If you are purchasing goods or services in the course of a business, certain statutory protections available to consumers under the Consumer Rights Act 2015 may not apply.
2. Orders & Contract Formation
2.1 Placing an Order
When you place an order through our website, it constitutes an offer to purchase goods. An order confirmation email acknowledges receipt but does not constitute acceptance or form a binding contract.
A legally binding contract is only formed when:

We dispatch the goods and you receive a dispatch confirmation email; or

A staff member confirms your order by phone or email.
Until then, we reserve the right to:

Decline, cancel, or limit any order;

Refuse orders due to pricing errors, stock issues, suspected fraudulent activity, misuse of discounts or promotions, or bot/reseller activity.
This complies with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and UK contract law.
2.2 Pricing Accuracy & Refusals
If a product is incorrectly priced, we may cancel the order even if payment has been taken. You will receive a full refund. We are under no obligation to honour pricing errors prior to dispatch.
3. Payments
All prices are in GBP (£) and include VAT where applicable. Prices may change without notice.

4. Dispatch & Delivery
4.1 Timescales
Orders placed before 13:00 GMT (Monday–Friday) are usually acknowledged within 48 hours.
In-stock items are typically dispatched within 2 working days.
Delivery is usually completed within 4 working days from dispatch.
Where possible, Ecotune will strive to dispatch on the same day.
We will inform you of any known delays, including restocking or manufacturing lead times, where reasonably possible.
Not all items listed on our website are held in physical stock at all times.
Stock availability displayed via third-party search engines or indexing services (including but not limited to Google, Bing, or Safari) may not reflect live stock levels. Ecotune accepts no liability for inaccuracies displayed by external platforms. Customers are encouraged to contact us directly for confirmation of current stock availability.
4.2 Delays & Liability
Delivery times are estimates only. Ecotune shall not be liable for courier delays, customs delays, or other external disruptions beyond our reasonable control.
4.3 Delivery Acceptance & Risk
Risk in goods passes to you upon delivery. If you are unable to inspect the parcel upon receipt, we recommend signing as “UNCHECKED” where possible.
5. International Shipping & Customs

Import duties, taxes, and customs charges are the responsibility of the customer.

Ecotune is not liable for customs delays or additional charges imposed by overseas authorities.
6. Cancellations & Your Right to Cancel
Consumers have 14 days from receipt of goods to cancel their order.

Goods must be returned within 14 days of cancellation notice.
7. Returns, Exchanges & Refunds
7.1 Return Conditions
Items must be:

Unused and in original condition;

Returned with original packaging;

Accompanied by proof of purchase.
7.2 Non-Returnable Items
The following are non-returnable:

Used or installed items;
-
Custom or bespoke parts (e.g., exhaust systems made to order);

Digital content, software, and digital services.
Digital content and digital services (including, where applicable, remote flashing, calibration files, activation keys, and electronically supplied tuning services) are non-returnable once performance has begun.
By purchasing digital content or a digital service, you expressly consent to immediate performance and acknowledge that you lose your statutory 14-day cancellation right once the download, installation, activation, or service delivery process has begun.
7.3 Return Costs
You are responsible for return postage unless the item is faulty. Special-order items may incur a 10% restocking fee.
7.4 Refunds
Refunds are issued within 14 days of inspection and will be returned to the original payment method.
7.5 Exchanges
Approved exchanges are typically dispatched within 2 working days.

8. Faulty Goods & Warranty
If goods are faulty, please email a description and supporting photographs where possible.
Where a fault is confirmed, goods may be repaired, replaced, or refunded in accordance with your statutory rights. Approved return postage costs for confirmed faults will be reimbursed.
9. Limitation of Liability
9.1
Nothing in these Terms limits or excludes liability for:

Death or personal injury caused by negligence;

Fraud or fraudulent misrepresentation;
-
Any liability which cannot lawfully be excluded under the Consumer Rights Act 2015 or other applicable legislation.
9.2
Subject to Clause 9.1, Ecotune shall not be liable for:

Indirect or consequential losses;
-
Loss of profits, income, or business opportunity;
-
Vehicle downtime;
-
Third-party failures including couriers or suppliers;
-
Improper installation, misuse, or unauthorised modification.
9.3
Ecotune’s total liability arising under or in connection with any contract shall not exceed the total price paid for the relevant goods or services.
10. Privacy & Data Protection
Ecotune processes personal data in accordance with the United Kingdom General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and applicable ICO guidance.
Personal data is processed lawfully for purposes including:

Contract performance;

Legal compliance;
-
Legitimate business interests;
-
Customer consent where required.
We do not sell customer data. Information will only be shared where:

Required by law;
-
Required by court order;
-
Required by regulatory or enforcement authority;

Necessary for payment processing or delivery services.

11. Vehicle Information Disclosure & Customer Confidentiality

Ecotune records and securely stores vehicle and customer information including registration numbers, VIN numbers, modification details, calibration data, dyno results, service history and invoices.
Where such data identifies an individual, it constitutes personal data under UK GDPR and is treated as confidential.
All vehicle records are linked to the original contracting customer. Ecotune shall not confirm, deny, or disclose to any third party:

Whether a vehicle has been worked on;
-
Modification details;
-
Performance figures;
-
Software data;
-
Invoices or service history.
This applies regardless of change of ownership.
Where a new owner requires information about the vehicle’s current condition, Ecotune may offer inspection, diagnostic, or dyno services under a new customer record.
Where the original customer requests access to their information, Ecotune may require reasonable identity verification before disclosure.
Nothing in this clause limits statutory data protection rights or legal disclosure obligations.
For the avoidance of doubt, Ecotune will not confirm whether a vehicle has been previously worked on unless the identity of the original contracting customer has been verified.
12. Performance Modifications & Off-Road Use
Certain products or software may be intended for motorsport, competition, or off-road use only, where stated.
Where road-legal options are available, this will be indicated at the point of sale.
The customer is responsible for ensuring compliance with road traffic laws, emissions regulations, insurance requirements, and manufacturer warranty conditions.
Ecotune accepts no liability for:

MOT failure;
-
Insurance invalidation;
-
Manufacturer warranty voidance;
-
Regulatory non-compliance;
-
Fines or penalties arising from vehicle use.
Customers must declare modifications to their insurer and ensure road legality.
13. Road Testing & Incidental Damage
Road testing may be carried out where reasonably required to verify performance and safe operation.
Testing is conducted by authorised personnel exercising due care and compliance with road traffic law.
Customers acknowledge inherent road risks including tyre punctures, stone chips, and debris-related damage.
Ecotune shall not be liable for incidental damage arising from unavoidable road hazards provided:

Testing was reasonable and proportionate;
-
The vehicle was visually checked prior to testing;
-
No negligence or misconduct occurred.
Any goodwill support offered does not constitute admission of liability.
14. Amendments to These Terms
Ecotune reserves the right to amend these Terms from time to time. The version in force at the time of placing an order shall apply to that contract.
15. Vehicle Storage, Retention & Collection
15. Payment and Collection
1.1 Vehicles must be collected promptly once work has been completed and the customer has been notified that the vehicle is ready for collection.
1.2 Full payment of all outstanding charges is required prior to release of the vehicle.
15.2 Right of Retention (Lien)
2.1 Ecotune UK Ltd reserves the right to retain possession of any vehicle until all outstanding sums owed, including charges for work carried out and any applicable storage fees, have been paid in full.
2.2 This right of retention applies in accordance with applicable law in Scotland.
15.3 Storage Charges
3.1 Where a vehicle is not collected following completion of work, Ecotune reserves the right to apply a storage charge.
3.2 Storage charges will apply from the date the customer is notified in writing, by email or letter, that storage charges will commence.
3.3 Storage will be charged at a rate of £30 per day unless otherwise agreed in writing.
3.4 Storage charges are intended to reflect reasonable costs associated with storage, security, insurance, and loss of operational capacity.
15.4 Storage Location & Security
4.1 Vehicles awaiting collection may be stored on site or at a secure off-site location at Ecotune’s discretion.
4.2 Ecotune shall not be responsible for delays in collection caused by non-payment.
15.5 Extended Storage & Disposal
5.1 If a vehicle remains uncollected for an extended period due to non-payment, Ecotune may, after providing reasonable written notice and in accordance with applicable law, take steps to recover outstanding charges.
5.2 This may include disposal or sale of the vehicle, with any surplus proceeds, after deduction of outstanding sums and reasonable costs, returned to the customer.
